BioShock 2 DLC Backlash Hits 2K

2K has been at the centre of accusations that their post-launch 'Sinclair Solutions Test Pack' DLC was sitting on the game disc all along, despite the download size being a slender 108k.
Selling for 400 Microsoft Points on the Xbox Live Marketplace, the DLC pack contains a stack of multiplayer content that would require a far more substantial download size, which has lead consumers to suspect that what they're actually paying for is an unlock key to access content already on the disc they've forked out for.
2K community manager '2K Elizabeth' addressed the claims regarding the Sinclair Solutions Test Pack on the publisher's forum, stating: "The way our engine and game structure works is that people need to have the exact same content for people to play together. One of the challenges with post launch content for MP is that it can split the player base, and we want to avoid that whenever possible.
"For this content, creating the DLC package the way we did allowed for us to not split the player base – so whether you purchase the new content or not, you can still play with your friends."
You'll notice that the response fails to directly address the accusations head on, but neatly sidesteps them instead. Replies on the forum have already called into question the technical validity of the reply, so expect this debate to run and run.
